In general the way I read what Dale had to say was:
When we elect officials we elect them to serve us and they take an oath to uphold the laws and our constitution.
There is a valid argument that that's not being done on this same sex marriage issue in this case. We don't elect officials to intentionally break the law and pull bizarre stunts to change the constitution.
What I also see in Dale's point is that the Bush administration could be brought up on charges for failing to uphold our laws and constitution and to intentionally attempt to undermine and subvert them.
