Basically, what Cannon used to throw out the case is the idea that Jack Smith was not properly appointed, which is false because the appointment guidelines are clear, which is what the Federalist society wrote, which Thomas argued in his opinion in the immunity case, and what Cannon wrote in her dismissal. What's amusing is this, if we go by that idea, pretty much every special counsel that has been appointed in the last 30 years has been not valid, and this includes the special counsel that has been appointed to investigate Hunter Biden. So, by that standard, that case should be thrown out as well. 

Will we hear any Republican, Right Wing media outlet, Trump and his cronies argue that? I think not. 

The rules to appoint a special counsel are clear, they have been followed, in the Trump cases, in the Biden case, all of them. So, basically what we have here are Thomas and Cannon INVENTING law that does not exist. 

I would assume the 11th Circuit restores the case and says that Cannon threw it out under false grounds. It's nonsense. However, we are living through such a bizarre time, I can't say with any certainty what will happen next. It looks obvious what should happen, but the Supreme Court ruled that the president is above all laws of the land and our Constitution if he/she says whatever they are doing is an official act.

I mean, I agree with David, it should horrify anybody that understands what is happening, these judges are just openly saying they will make shit up to accomplish their agenda. I just have no clue how many people understand it.
