On paper, you're right - in practice you're wrong. Had Al Gore sat tight (as KH suggested) a statewide recount would have kicked in - and we'd be in a different position today. The only trouble was, the election was flawed across about 5 states in one way or another (Florida, Iowa, Missouri, NY, New Mexico) - so IMO unless there was a national revote, the US Supreme Court were right in applying "the greatest good for the greatest number".
I question who the real facists were when the Ayotollah's of the DNC were ready to dump on the whole country by snagging 3 counties in Florida. Had there been a statewide revote, Gore would have won without question. But with that said, after the events of 9/11 in the light of Clinton's 8 year inaction over OBL and Gore's role in the Buddhist temple farago, I think many people were thanking their own personal God that GW was at the helm.
