Very scary. The practice sounds totally unconstitutional, but has it been legally challenged? The present government totally ignores certain constitutional rights anyways, and they seem to do whatever they please and get away with it. I would say that unless your brother has the type of funding necessary for a very aggressive and intelligent attorney, or legal team, that he will be S.O.L.
When I read the book 1984, by George Orwell, during High School, I thought the things he discussed in there were fantasy, but interesting. I could never imagine such things in US or Canada, but they have all, and moreso come to pass.
