Funny, that's exactly how Hugo Chavez operated in Venezuela. First, he won a national election in 1999. He used the first two years of that term to ram through a referendum to form committees to change the constitution. After adoption of that, he ran for president again. In the new system, the president was allowed to double the size of the high court, which was immediately packed with Chavez cronies. The legislative branch was similarly pared down from two houses to one popular house, which more or less ensured lockstep voting with the president. Finally, charges of widespread election fraud led the opposition parties to protest an election, which cost them what little minority voice they had in the congress.
For all the problems and allegations (many serious) that the USA has had during the past seven years, I can't see anything that even comes close to the Chavez fascism.
