Yeah, I think Obama actually over-explained it in his speech. What he should have said is that construction of the facility should proceed or not proceed in strict accordance with the law. As President, he's sworn to uphold the Constitution. Any legal challenges get heard in court and decided by judges. The Executive and Legislative branches of government should not have a dog in this hunt.

(All that said, the Islamic group pushing this project are fools if they believed this would pass through without some scathing comments. They've already compromised their mission.)
