The US has signed the Geneva Convention documents. What is a non-uniformed enemy combatant, and how does one get that designation? Can it be challenged?

What happens when/if anyone with a legitimate beef can be branded a terrorist? Were the American revolutionaries terrorists?
I have not doubt the ACLU has taken some cases that maybe they shouldn't have. But I'm afraid that without that pushback on the government, our civil liberties would already be so eroded as to be meaningless. Some might say it is already so.
