Yes, based on the legal and civic definitions of "treaty" and the nature of the agreement which our government signed it is in fact a treaty. Most law references refer to it as a "treaty" so I understand what you were saying but I expect you would be under a far greater legal burden to prove it is not a treaty than to prove that it is. You are looking for "wiggle room" and I think that would come in the form of our government claiming that the war with Iraq was done as a matter of "security" and was in the interest of the greater good. This has always been disputed and more government officials are on the side that this was not done as a matter of security and has in fact made people around the world less secure. So, if in some strange dream world Bush and Cheney were ever put on trial for war crimes I do not think their defense would be that the UN Charter does not constitute a treaty.
