They don't host any servers, so they skirt the legality that way.
It works off the Gnutella peer-to-peer network, so each participant is a client and server in the default mode. You can change this in settings - as long as you don't act as a server, you are legal - or at least you won't get any knocks on the door... One warning - My ISP shut me down when I acted as a server and left my PC on overnight to download some files - it seems I used up too much bandwidth. I had to call and have the modem reset.
