Yes, but who decides what constitutes "national security." Nixon said "when the President says so." But the Supreme Court shot him down 8-0 on the issue of spying. Presidents get away with things as long as nobody knows about it, but once it becomes public and should the matter be raised before the Supreme Court, the answer is clear: the President does not have such power, and nobody is above the law.
