Generally speaking, United States Copyright Law is Title # 17 of the United States Code. There is a section called FAIR USE that consists of Sections 107-118 of Title # 17.

If you want to duplicate someone's work, at a minimum, you must make a note of this on the work itself. For instance, for your use of the TRIAGE cover, you might do the following:

Triage cover art (c) 1992 A&M Records All rights reserved. Used under FAIR USE SECTIONS of US CODE TITLE # 17, SECTIONS # 107-118.

You can write to the copyright holder, and get specific permission, but since this is a giveaway item, the law does not apply in quite the same manner, as if you were selling copies.

Also, even though an original artwork was modified, does not make you the artist of the new image. At a minimum there, you are a co-artist, and the original artist's name should go first, and yours second.

I am running into these very same issues in the writing of my book. I have researched this, and have more info if you want to write me privately.

One of the things I did was burn a CD-ROM of the entire US CODE in searchable PDF file format, for later use.

You can also go to the US COPYRIGHT OFFICE website, and they have lots of further information there.
