It would help if Thomas argued the points directly - Richardsons reasoning centered around abuses by Law enforcement and Prosecutors, while Thomas argues legal loopholes.  The sensational examples further erode the argument.  While I agree that Richardson should have gone on a case by case basis, Thomas's argument proves faulty.
